CHARTER TOWNSHIP OF HIGHLAND
ORDINANCE NO. 456
AN ORDINANCE TO AMEND SECTIONS IN ARTICLE V OF CHAPTER 9 OF THE CODE OF ORDINANCES OF THE CHARTER TOWNSHIP OF HIGHLAND REGARDING THE FIRE DEPARTMENT TO ADD BATTALION CHIEFS TO THE AUTHORIZED POSITIONS AND CHAIN OF COMMAND.
THE CHARTER TOWNSHIP OF HIGHLAND ORDAINS:
Section 1. Amendments
Sections 9-118(b) and 9-119(a) in Article V of Chapter 9 of the Code of Ordinances, Charter Township of Highland, Michigan (or Highland Charter Township Code), are hereby amended to read as follows:
Sec. 9-118. - Chief; duties.
(b) The Chief shall recommend, subject to Township Board approval, the appointment of a Fire Marshall, Assistant Chief, Battalion Chief(s), Captain(s), Lieutenant(s), Sergeant(s) and Firefighters as may be deemed necessary.
Sec. 9-119. - Officers.
(a) There shall be a chain of command established among the department officers in descending order of rank, from the Chief to the Assistant Chief, Battalion Chief(s), Captain(s), Lieutenant(s), Sergeants, to Firefighters. Each rank shall obey the orders of their superior officers. Temporary officers may be appointed by the senior officer present at any emergency to ensure the continuity of the chain of command. Such temporary appointments shall terminate when the officer with the given responsibility becomes available.
Section 2. Savings Clause.
Nothing in this Ordinance hereby adopted shall be construed to affect any just or legal right or remedy of any character nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Ordinance.
Section 3. Severability.
The various parts, sections and clauses of this Ordinance are declared to be severable. If any part, sentence, paragraph, section or clause is adjudged unconstitutional or invalid by a court of competent jurisdiction, the remainder of the Ordinance shall not be affected.
Section 4. Adoption and Effective Date
